The November 2026 problem

On November 12, 2026, the federal definition of hemp starts measuring total THC instead of delta-9 alone. Two numbers, and they are not the same number:

• 0.3% total THC by dry weight — the plant-level threshold. The percentage is unchanged from 2018. What it counts is not: THCa now converts and gets included.
• 0.4 mg total THC per container — an absolute cap on finished consumable products, where container means the innermost packaging at retail. A typical hemp gummy runs 2.5 to 10 mg.

If you touch hemp-derived product, your compliance posture, your COAs, and possibly your entire SKU list need to be reassessed before then — not after.
